Use of Services

You must be at least 18 years old to use our services. By using them you represent that you are of legal age to form a binding contract under the Indian Contract Act, 1872, and that where you are acting for an organisation you are authorised to bind it.

This website is directed at businesses. We do not knowingly collect the personal data of anyone under 18, and the Digital Personal Data Protection Act, 2023 treats a person under 18 as a child whose personal data may be processed only with verifiable consent from a parent or lawful guardian.

User Conduct

You agree to use our services in compliance with all applicable laws and regulations. You are solely responsible for your conduct and any content, including but not limited to text, images, videos or other materials, that you upload, share or display while using our services. You must not engage in any activity that interferes with or disrupts our services or networks.

Intellectual Property

All content and materials available on our website or through our services, including but not limited to text, graphics, logos, images, software and trademarks, are the property of Bitchief or its licensors and are protected by intellectual property laws. You may not use, modify, reproduce, distribute or exploit any of our content without our prior written consent.

Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that our services will be error-free, secure or uninterrupted.

Limitation of Liability

Bitchief shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to lost profits, arising from your use of our services or any content available through our services.

Indemnification

You agree to indemnify, defend and hold harmless Bitchief and its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses arising out of or in any way connected with your use of our services or violation of these Terms.

Personal data and cookies

Our Privacy Policy explains what personal data we collect through this website, the specific purpose of each item, who we share it with, how long we keep it, and the rights you have over it as a Data Principal under the Digital Personal Data Protection Act, 2023. It forms part of these Terms.

Cookies that are strictly necessary to run the site and protect its forms are set on every visit. Analytics and the live-chat widget are not loaded at all unless you consent to them, and you can grant or withdraw that consent at any time from the cookie preferences panel, reachable from the footer of every page. Withdrawing consent does not affect your ability to use this site or to contact us.

Where we operate systems for a client organisation under a separate agreement, we act as a Data Processor on that client's instructions and their privacy notice governs that processing, not ours.

Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to the grievance process below, the courts at Gurugram, Haryana have exclusive jurisdiction over any dispute arising out of or in connection with them.

REVIEW NOTE: confirm the intended seat of jurisdiction. Gurugram is stated here because it is the registered corporate office address published on this site; that is an inference, not an instruction from anyone.

Grievances

If you have a complaint about these Terms, about our services, or about how we have handled your personal data, contact our Grievance Officer using the address at the end of this document. We will acknowledge your complaint and respond within the period the applicable law allows.

For a grievance about personal data specifically, if we do not resolve it you may escalate it to the Data Protection Board of India.

REVIEW NOTE: a Grievance Officer has to be appointed and named, here and in the Privacy Policy, before either document is published.

Changes to Terms

We may update these Terms. The date at the top of this page shows when they were last changed, and your continued use of the website after a change constitutes acceptance of it.

A change to how we handle personal data is treated differently, because consent cannot be updated by posting a new page: a material change to the Privacy Policy increments the version attached to the cookie notice, which asks for your choice again rather than carrying forward a decision you made about a different notice.
